1. Introduction

Welcome to Tunnme, a platform operated by KO Technologies LLC (“Tunnme,” “we,” “our,” or “us”).
These Terms of Service (“Terms”) govern your access and use of Tunnme’s website, platform, and related services (the “Services”).
By creating an account, accessing, or using Tunnme, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, please do not use the platform.

2. Who We Are

Tunnme connects Earners (creators, experts, or professionals) who publish video content, with Learners who purchase and watch it.
We provide the technology and payment infrastructure but are not the direct provider of the educational or informational content offered by Earners.

3. Eligibility

You must be at least 18 years old to create an account or use Tunnme.
By registering, you confirm that all information provided is accurate, complete, and current.

4. Account Registration

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You agree not to share or sell your account access.
Tunnme may suspend or terminate accounts involved in fraudulent, misleading, or illegal activities.

5. Description of Services

For Learners

You can browse and purchase video content created by Earners.
Each video purchase grants at least 12 months of streaming access from the purchase date.
Videos are for streaming only and cannot be downloaded.
After the guaranteed access period, Tunnme may remove or deactivate videos from the platform for operational, policy, or storage reasons.
In such cases, Learners will be notified in advance through the platform or by email before the content is permanently removed or expires.

For Earners

You can upload, price, and manage your video content through your Earner account.
Access to creator tools requires an active membership plan. Tunnme currently offers a monthly membership priced at USD 10.99, which renews automatically every month and grants access to upload, host, and sell video content through the platform.
In the future, Tunnme may introduce additional membership tiers with different pricing, benefits, and technical limits — such as total hours of uploaded video, number of active videos, or access to advanced features. Each plan’s details and restrictions will be clearly displayed on the platform at the time of purchase or upgrade.
Any change to membership pricing or plan features will be communicated in advance and will apply only to future billing cycles.
If you cancel your membership, your videos will no longer be available for new purchases once your current billing cycle or any applicable grace period has ended.
During that time, you will still retain access to your dashboard and content management tools.
After the grace period expires, your videos will be temporarily hidden from public view and may be permanently deleted from our servers in accordance with Tunnme’s data retention and storage policies.
You will not be able to upload new content or access creator analytics while your membership remains inactive.
If your videos are deleted due to prolonged inactivity, you will need to re-upload them upon reactivation of your membership.
Existing Learners will continue to have access to any videos they previously purchased for at least 12 months from the original purchase date.
After this guaranteed access period, Tunnme may remove or deactivate videos for operational, policy, or storage reasons. In such cases, Learners will be notified in advance through the platform or by email before permanent removal.

6. Payments and Fees

All payments are processed securely through Stripe or other approved payment processors.

Learners pay the total amount displayed at checkout, which includes the price set by the Earner plus a small platform fee that supports the operation and development of Tunnme.

Earners pay a monthly membership fee of USD 10.99 to publish and monetize their content.

Payments are non-refundable except as outlined in our Refund Policy.

Tunnme reserves the right to adjust fees, introduce new charges, or modify pricing structures in the future with prior notice to users.

7. Membership Plans

Creator Membership Plans
Earners must maintain an active membership plan to publish and monetize their content on Tunnme.
Tunnme currently offers a monthly membership priced at USD 10.99, which renews automatically each month and grants access to upload, host, and sell video content through the platform.

8. Tax Obligations

Each Earner is solely responsible for determining, reporting, and paying any taxes that may apply to earnings generated through Tunnme, according to the tax laws of their country of residence.
Tunnme and KO Technologies LLC do not provide tax advice and are not responsible for withholding, collecting, or remitting any taxes on behalf of Earners, except where legally required.

Tunnme partners with Stripe as its payment processor. Stripe may request certain tax information (such as Form W-9 for U.S. persons or Form W-8BEN for non-U.S. persons) to comply with applicable regulations, including those of the U.S. Internal Revenue Service (IRS) and international tax authorities.
Failure to provide accurate or complete tax information may result in delayed or suspended payouts until compliance is achieved.

Earners agree to indemnify and hold Tunnme harmless from any claims, penalties, or liabilities arising from their failure to meet tax obligations.

9. Supported Payout Countries

Payouts to Earners are processed through Stripe, and are only available in countries where Stripe’s payout services are supported.
Earners must have a valid bank account or payout method in a supported country to receive funds.

If an Earner is located in a country that is not supported by Stripe, they may still create an account and upload content, but payouts will remain pending until Stripe expands its payout coverage or an alternative payout solution is provided by Tunnme.

Tunnme reserves the right to modify or add payout options in the future and will notify users in advance if such changes affect their ability to receive earnings.

10. Content Ownership and License

Earners retain full ownership of their videos and all associated intellectual property rights.

By uploading content to Tunnme, you grant Tunnme a limited, non-exclusive, worldwide, royalty-free license to host, stream, and display your content to users who have purchased access.
This license remains in effect for as long as necessary to provide access to Learners under these Terms, even if you later remove or deactivate your content or account.

If you choose to delete or unpublish your videos, Tunnme will ensure that no new purchases are allowed, but existing Learners will continue to have access for at least 12 months from the original purchase date, or for a longer period if Tunnme decides to extend access availability.

After the guaranteed access period has passed, Tunnme may continue to host and display your content at its discretion, as long as it remains active, available for purchase, or relevant to Learners.
If Tunnme decides to remove the content for operational, policy, or storage reasons, it will be removed from public access and deleted in accordance with our data retention policy, with reasonable prior notice will be provided to affected Learners before permanent removal.

This clause remains in effect even if you later remove your content or terminate your account, to the extent necessary to honor prior Learner purchases and any ongoing access periods.

11. Prohibited Conduct and Content Responsibility

Users are solely responsible for the content they upload, publish, or share through Tunnme.
By using the platform, you confirm that your content complies with all applicable laws and does not infringe any third-party rights, including copyright, privacy, or publicity rights.

Tunnme allows a wide range of creative and educational content, as long as it complies with these Terms and our Community Guidelines. However, the following are strictly prohibited:

Uploading or distributing illegal, harmful, or infringing material.
Sharing or promoting hate speech, discrimination, or violence.
Uploading adult or sexually explicit content involving minors, violence, or non-consensual acts.
Engaging in fraud, impersonation, or misrepresentation.
Attempting to hack, reverse-engineer, or interfere with Tunnme’s systems.
Circumventing payment systems or conducting off-platform transactions related to Tunnme content.

Tunnme does not pre-screen or endorse user-generated content and is not responsible for any materials uploaded by Earners or Learners.
However, Tunnme reserves the right to remove, restrict, or report content that violates these Terms, applicable laws, or third-party rights, and to suspend or terminate any account involved in such violations.

Users acknowledge that by uploading content, they assume full legal and moral responsibility for that content, including any consequences arising from its publication or distribution through Tunnme.

12. Refunds

All video purchases and membership fees are final and non-refundable, except in cases of verified technical issues as defined in our Refund Policy.

13. Privacy

We respect your privacy and handle your personal data according to our Privacy Policy.
Please review it carefully to understand how your data is collected, used, and protected.

14. Future Services and Features

Tunnme may introduce new services to enhance user experience, including but not limited to:

Classic meet: one-on-one personalized sessions.
Community meet: multi-user or group sessions.
Quick call: short or on-demand video interactions.
Each feature will have its own specific terms and pricing once officially launched.

15. Termination and Suspension

Tunnme reserves the right to suspend or terminate your account at any time if:

You violate these Terms or our Community Guidelines.
You engage in fraudulent, abusive, or illegal activity.
You may also close your account at any time by contacting us at [email protected].

16. Limitation of Liability

Tunnme provides the platform and all related services “as is” and “as available,” without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, Tunnme and its affiliates, officers, employees, and agents make no warranties or representations about the operation, availability, reliability, or accuracy of the Services, or that they will be uninterrupted, secure, or error-free.

Tunnme is not responsible for:

The quality, accuracy, or reliability of any content uploaded by Earners.
Any loss, damage, or harm arising from your use of Tunnme or its content.
Any interruption, error, delay, or inability to access the Services.

To the fullest extent permitted by applicable law, Tunnme shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or reputation, even if Tunnme has been advised of the possibility of such damages.

In all cases, Tunnme’s total cumulative liability for any claim arising out of or relating to the use of the platform shall not exceed the total amount paid by you to Tunnme in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so parts of this section may not apply to you to the extent prohibited by law.

17. Dispute Resolution and Governing Law

These Terms shall be governed by the laws of El Salvador.
Any dispute, claim, or controversy arising from these Terms shall be resolved through binding arbitration administered by the Mediation and Arbitration Center of the Chamber of Commerce and Industry of El Salvador, seated in San Salvador, and conducted in Spanish.
Each party shall bear its own costs unless otherwise determined by the arbitration tribunal.

The arbitration decision shall be final and binding on both parties.

18. Modifications

Tunnme may update these Terms periodically.
When changes occur, users will be notified via email or within the platform.
Continued use of Tunnme after updates constitutes acceptance of the revised Terms.
